Lecture follow up: Jill Peay’s Lent Lecture on fitness to plead

Professor Peay referred to Prichard (1836) 7 C & P 303, Antoine [2000] UKHL 20 and H [2003] UKHL 1, as well as sections 4 and 4A of the Criminal Procedure (Insanity) Act 1964.

Professor MacKay’s work on fitness to plead includes ‘Protecting the Unfit to Plead – A Comparative Analysis of the “Trial of the Facts”’ (2005) Juridical Review 173, ‘A Continued Upturn in Unfitness to Plead – More Disability in Relation to the Trial’ [2007] Criminal Law Review 530-545 (available on Westlaw), and there is also an interesting piece comparing the English and American approaches.
